Okay, so last month, an amendment was passed to the Film and Publications Act, which it seems may be taking away our freedom of speech!
I think that’s a pretty major issue! Do you think I can find anything in plain language (not legalese) on the net which tells me what I can and can’t do, can and can’t say, can and can’t sell, etc.? NO!!!!
I wasn’t even aware of this act until a client of mine asked me last week how the act was affecting my online business. Gulp! Act? What Act? So of course, I rushed to my first port of call … Google and googled my little tush off and all I could find was more questions and vague legal speak! But something that concerned me was that Adult World had taken their website down due to the change in the law.
So – what is all this about?
Well – this is what I have managed to established …
The law was enacted to try and prevent child pornography (100% for that, duh!) and also to prevent children from being exposed to adult content (100% for that as well naturally) BUT the problem is it’s written so broadly (as law is) and definitions aren’t clear so it begs the question if I have the word SEX on my blog, am I breaking the law? It also appears that you need to get approval from the Film and Publications Board before publishing stuff! So if I want to write a blog on my boutique’s blog about the art of the 69 (which we have), I now have to get approval from the board first?!?!?! WTF!!! Woops, is that hate speak??? I may have to sit in the tjookie for 5 years! Thank goodness the FXI (Freedom of Expression Institute) is appealing this law, etc. I have just emailed them and hope they can shed some light on this rather confusing topic.
I can’t seem to find the answer anywhere, so please comment if you know or can point me in the right direction.
